This Privacy Policy outlines how we at PromptMed Urgent Care, collect, use, disclose, and protect your personal information in accordance with the Health Insurance Portability and Accountability Act (HIPAA) and the Illinois Personal Information Protection Act (PIPA). This Private Policy will also outline your rights regarding your personal health information as a patient at PromptMed Urgent care. We must follow the Privacy Policy and terms of this notice while it is in effect.

By using our company-owned and -operated website, www.MyPromptMed.com, or digital properties that link to this Privacy Policy and our related email, phone, and other electronic communications, social media pages and marketing activities (collectively called our “website”) you are accepting the practices described in this policy. Please review carefully.

INFORMATION COLLECTION:

We create a record of the care and services you receive at our organization, and we need this record to provide you with quality care and to comply with certain legal requirements. The personal health information we, PromptMed Urgent Care, collect includes, but is not limited to:

Contact information, such as name, phone number, email address and account name. Demographic information, such as zip code and date of birth. Medical history and health information, insurance information and payment information (if applicable). This information is collected through online forms and in-person registration.

We may collect non-personal information, such as a domain name and IP address. The domain name and IP address reveals nothing personal about you besides the IP address from which you have accessed our website. We may also collect information about the type of internet browser you are using, operating system, what brought you to our website, as well as which of our web pages you have accessed. This information is collected using “cookies”, which will be explained in more detail later in this Privacy Policy.

USE OF INFORMATION:

We may use your personal health information for treatment, payment, and healthcare operations. Here are some non-exhaustive examples:

Treatment: We may use or disclose your personal health information to other healthcare providers providing treatment to you.

Payment:  We may use and disclose your personal health information to obtain payment for services we provide to you.

Healthcare Operations: We may use and disclose your personal health information in connection with our healthcare operations. Healthcare operations include quality assessment and improvement activities, reviewing the competence or qualifications of healthcare professionals, evaluating provider performance, conducting training programs, accreditation certification, licensing, or credentialing activities.

Reminders/Notifications: Our staff will use your personal health information to send you follow-up care, referrals, or appointment reminders.

Marketing Health-Related Services: We may use your personal health information internally to offer goods and services we believe may be of interest to you. We may use your information to contact you to inquire or survey, regarding the patient experience at the location(s) visited and the prospect of future services or improvements needed to continue as your services provider and other inquiries.

We may utilize one or more third-party service providers to send emails, SMS messages or other communications to you on our behalf including, but not limited to, patient satisfaction surveys. These service providers are prohibited from using your email address, phone number, or other contact information for any other purpose than to send communications on behalf of PromptMed Urgent Care.

We will not sell or otherwise provide the information we collect to outside third parties for the purpose of direct or indirect mass email marketing.

DISCLOSURE OF INFORMATION:

We may disclose your personal health information under the circumstances listed below:

Your Authorization: In addition to our use of your personal health information, as outlined in this Privacy Policy, you may give us written authorization to use your personal health information or to disclose it to anyone for any purpose. If you give us an authorization, you may revoke it in writing at any time. Your revocation will not affect any use or disclosures permitted by your authorization while it was in effect. Unless you give us written authorization, we cannot use or disclose your personal health information for any reason except those listed in this Privacy Policy.

To Your Family and Friends: We may disclose your personal health information to a family member, friend, or other person to the extent necessary to help with your healthcare or with your payment for your healthcare, but only if you agree that we may do so.

Persons Involved in Your Care: We may disclose your personal health information to notify or assist in the notification of (including identifying or locating) a family member, your personal representative, or another person responsible for your care, of your location, your general condition, or death. If you are present, then prior to use or disclosure of your personal health information, we will provide you with an opportunity to object to such uses or disclosures. In the event of your incapacity or emergency circumstances, we will disclose personal health information based on a determination using our professional judgement disclosing only personal health information that is directly relevant to the person’s involvement in your healthcare.

We will use our professional judgement and our experience with common practice to make reasonable inferences of your best interest in allowing a person to pick up prescriptions, medical supplies, x-rays, or other similar forms of health information, on your behalf.

Accrediting/Regulatory Bodies: We are surveyed by organizations who may have access to your personal health information to ensure that we are providing quality service.

Military and Veterans: If you are a member of the armed forces, we may disclose your personal health information as requested by the military command authorities.

Medical Examiner/Funeral Director: We may disclose personal health information with a coroner, medical examiner, or funeral director as necessary for them to carry out their duties.  

Worker’s Compensation and Law Enforcement: We may disclose personal health information about you for worker’s compensation claims and for law enforcement purposes or with a law enforcement official, as permitted by law.

Fundraising: We will not use your personal health information for fundraising activities without your consent.

Required by Law: We may disclose your personal health information when we are required to do so by law.

Abuse or Neglect: We may disclose your personal health information to appropriate authorities if we reasonably believe that you are a possible victim of abuse, neglect or domestic violence or the possible victim of other crimes. We may disclose your personal health information to the extent necessary to avert a serious threat to your health or safety, or the health or safety of others.

National Security: We may disclose to military authorities the personal health information of Armed Forces personnel under certain circumstances. We may disclose, to authorized federal officials, personal health information required for lawful intelligence, counterintelligence, and other national security activities. We may disclose to correctional institutions or law enforcement officials having full custody of personal health information of inmates or patients under certain circumstances.

SECURITY MEASURES:

We follow generally accepted industry standards to protect the personal health information submitted to us, both during transmission and once we receive it.

In the event of a breach of personal health information, we will provide you with a notification as required by the Health Insurance Portability and Accountability Act (HIPAA).

If we collect sensitive information, such as credit card data, that information is run through software which is both PCI compliant and encrypted.

While we use encryption to protect sensitive information, we also protect your information offline. Only employees who need the information to perform a specific job, such as billing or specific health information, are granted access to personally identifiable information and the computer/servers in which we store personally identifiable information are kept in a secure environment.

It is important to note that no method of transmission over the internet, or methods of electronic storage, is fully secure. While we use reasonable efforts to protect your personal health information from the risks presented by unauthorized access or acquisition, we cannot guarantee the security of your personal information.

PATIENT RIGHTS:

Access: You have the right to look at or get a copy of your personal health information, with limited exceptions. You may request that we provide copies in a format other than photocopies. We will use the format you request unless we cannot practically do so. We may charge a fee for producing medical records and x-rays as allowed by law.

Disclosure Accounting: You have the right to receive a list of instances in which we have disclosed your personal health information for purposes other than treatment, payment, healthcare operations and certain other activities. The request must be written and must include the time period the accounting is to cover. This time period may not be longer than 6 years prior to the date of your request. We may charge a fee for responding to these requests.

Restriction: You have the right to request that we place additional restrictions on our use of disclosure of your personal health information. We are not required to agree to these additional restrictions, but if we do, we will abide by our agreement (except in an emergency). When you pay in full outside of your insurance plan for services, you may request that we restrict this information and not disclose it to your healthcare plan or insurer.

Alternative Communication: You have the right to request that we communicate with you about your personal health information by alternative means or to alternative locations. This request must be written. Your request must specify the alternative means or location and provide satisfactory explanation as to how payments will be handled under the alternative means or location you requested.

Amendment: You have the right to request that we amend your personal health information. This request must be written, and it must explain why the information should be amended. We may deny your request under certain circumstances.

Electronic Notice: If you have received this notice on our website or through email, you are also entitled to receive a printed copy of this Privacy Policy.

DATA RETENTION:

We retain your personal health information for 10 years, as required by law, and as necessary for our business operations. After this period, we securely dispose of this data.

COOKIES:

We use “cookie” technology on our website. A “cookie” is an encrypted piece of data stored on a site visitor’s hard drive to help us improve your access and identify repeat visitors on our website. The two types of cookies we utilize are “session” cookies, which are temporary, and are automatically deleted once you leave our website, and “persistent” cookies, which will “remember” information like your preferences or log in credentials. Both “session” and “persistent” cookies are used throughout the online process to keep together information entered on multiple pages.

We do not use cookies to gather any personally identifiable information about you apart from what you voluntarily provide us in your dealings with us. Our cookies do not corrupt or damage your computer, programs, or computer files. You can manage your cookie preferences through your browser settings.

CHANGES IN PRIVACY POLICY:

 We reserve the right to change our Privacy Policies and the terms of this notice at any time, provided such changes are permitted by applicable law. The revised Privacy Policy will be applied to all personal health information we maintain. You have the right to a paper copy of this Privacy Policy.

EFFECTIVE DATE: This Privacy Policy is effective 9/28/23 and replaces all earlier versions.
